These Terms and Conditions ("Agreement") govern your use of the website operated by Robert & Associés Notaires Inc ("the Office", "we", "us", "our") at robertoandas.click, and your participation in our document organisation sessions, property paperwork programmes, and estate terminology series (collectively, "Services").
By accessing this website or registering for any Service, you agree to be bound by this Agreement. If you do not agree, please do not use this website or our Services.
TABLE OF CONTENTS
1. Definitions
- "Agreement" means these Terms and Conditions, our Privacy Policy, and Cookie Policy collectively.
- "Service" or "Services" means the Family Records Organisation Session, the Property Paperwork Checklist Program for Realtor Teams, and the Estate Terminology Information Series offered by the Office.
- "User" means any individual or organisation that accesses this website or participates in a Service.
- "We / Us / Our" refers to Robert & Associés Notaires Inc, located at 183, rue Principale, St-André-Avellin, QC J0V 1W0.
- "Content" means all text, templates, checklists, glossaries, recordings, and materials provided in connection with a Service.
- "Session" means a scheduled individual or group meeting (in person or remote) forming part of a Service.
2. Acceptance of Terms
By using this website or booking any Service, you confirm that:
- You are at least 18 years of age or have the consent of a parent or guardian
- You have the legal capacity to enter into a binding agreement
- You accept this Agreement in full
If you are booking on behalf of an organisation, you confirm that you are authorised to do so and that the organisation is bound by this Agreement.
3. Service Description
The Office provides the following informational and organisational services:
- Family Records Organisation Sessions — a 2-hour practical session for households, focused on building a personal document index and storage system. CAD 140 per session.
- Property Paperwork Checklist Program for Realtor Teams — a 3-week workflow programme for brokerage teams of 4–20, including planning, template delivery, training, and a review session, with 45 days of written follow-up. CAD 480 per programme.
- Estate Terminology Information Series — a four-part educational series (4 × 75 minutes) covering vocabulary found in family and property documents, with replay access for 120 days. CAD 910 per series.
Our Services are informational and organisational in nature. They do not constitute legal advice, notarial services, or guidance on any individual's personal circumstances. Nothing provided in connection with a Service should be relied upon as professional advice.
4. User Responsibilities
- Provide accurate information when booking or completing the contact form
- Attend scheduled sessions at the agreed time or give reasonable advance notice if unable to attend
- Use all Content and materials for personal or internal organisational use only
- Not reproduce, distribute, sell, or publicly display any materials provided in connection with a Service without our prior written permission
- Not use this website or our Services for any unlawful purpose
- Not interfere with the proper operation of this website
5. Intellectual Property
All Content — including checklists, templates, glossaries, handover sheets, session recordings, and written materials — remains the intellectual property of Robert & Associés Notaires Inc.
Upon payment, you receive a limited, non-exclusive, non-transferable licence to use the materials delivered as part of your specific Service for your personal household use or for internal use within your brokerage team, as applicable.
You may not resell, sublicence, publish, or distribute any Content to third parties without prior written consent from the Office.
6. Payment Terms
- All prices are stated in Canadian dollars (CAD) and include applicable Quebec sales tax (QST) and GST unless otherwise noted
- Payment is due prior to the first session of each Service unless otherwise agreed in writing
- Accepted payment methods include e-transfer, cheque, and other methods confirmed at the time of booking
6.1 Cancellation and Rescheduling
- Cancellations made more than 5 business days before a session: full refund of any prepaid amount
- Cancellations made 2–5 business days before a session: 50% refund or option to reschedule at no additional cost
- Cancellations made less than 2 business days before a session: no refund, but one rescheduling opportunity is offered at the Office's discretion
- If the Office must cancel a session, a full refund will be provided or the session rescheduled at a mutually convenient time
7. Service-Specific Terms
7.1 Family Records Organisation Sessions
- Sessions are delivered in person at our office or at a location agreed in advance
- The session covers general organisational principles and does not address any individual's specific legal situation
- Template materials provided are for personal household use only
7.2 Property Paperwork Checklist Program
- Programmes are sized for brokerage teams of 4 to 20 participants
- The scope of the template pack is determined during the planning call; changes to scope after delivery may require a revised agreement
- Written follow-up is available for 45 calendar days from the date of the review session
- Materials are licensed for internal use within the subscribing brokerage only
7.3 Estate Terminology Information Series
- The series consists of four 75-minute sessions; attendance at all four is recommended for full value but is not required
- Replay access is available for 120 calendar days from the date of the final session
- Content is general education only and does not address individual estate or succession matters
- Participants may not record, distribute, or reproduce session recordings
8. Disclaimers
Our Services are provided for informational and organisational purposes only. Nothing provided by the Office — whether during a session, in written materials, or through this website — constitutes legal advice, notarial services, financial advice, or guidance on any specific personal or organisational matter.
The Office does not represent or warrant that the information provided is complete, accurate, or up to date with respect to any particular user's circumstances. Users are encouraged to seek independent professional advice for matters specific to their situation.
This website and its Content are provided on an "as available" basis without representations about uninterrupted access.
9. Limitation of Liability
To the maximum extent permitted by applicable law, the Office's liability to any User for any claim arising from or related to a Service shall not exceed the total amount paid by that User for the specific Service giving rise to the claim.
The Office shall not be liable for indirect, consequential, incidental, or special damages — including loss of data, lost profits, or business interruption — even if advised of the possibility of such damages.
The Office is not liable for delays or failures in performance resulting from circumstances outside our reasonable control, including network disruptions, utility failures, or other force majeure events.
10. Indemnification
You agree to indemnify and hold harmless Robert & Associés Notaires Inc, its notaries, and administrative staff from any claims, losses, damages, or expenses (including reasonable legal costs) arising from your breach of this Agreement or your misuse of the Services or Content.
11. Termination
- Either party may terminate participation in a Service with reasonable advance notice
- The Office reserves the right to refuse or discontinue a Service to any User who breaches this Agreement
- Upon termination, access to any digital materials or replay recordings will cease at the end of the applicable access period
- Sections 5 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), and 12 (Dispute Resolution) survive termination
12. Dispute Resolution
This Agreement is governed by the laws of the Province of Québec and the applicable federal laws of Canada. Any dispute shall be subject to the exclusive jurisdiction of the courts of Québec, sitting in the district of Papineau.
Before commencing formal proceedings, the parties agree to attempt informal resolution by contacting the Office in writing at [email protected] and allowing 30 days to seek a resolution in good faith.
Quebec consumer protection laws, including the Consumer Protection Act (RLRQ c P-40.1), may apply to Users who are Quebec residents acting for personal purposes.
13. General Provisions
- Entire Agreement — this Agreement, together with the Privacy Policy and Cookie Policy, constitutes the entire agreement between the parties concerning its subject matter
- Severability — if any provision is found unenforceable, the remaining provisions continue in full force
- Waiver — failure to enforce any provision does not constitute a waiver of the right to enforce it in future
- Assignment — you may not assign your rights under this Agreement without our prior written consent; we may assign our rights in connection with a sale or restructuring of the Office
- Notices — formal notices under this Agreement should be sent by email to [email protected] or by mail to our office address
14. Changes to These Terms
We may update these Terms and Conditions from time to time. The updated version will be posted on this page with a revised effective date. For material changes, we will post a notice on our homepage. Continued use of our website or Services after changes become effective constitutes acceptance of the updated terms.
